1. Acceptance of Terms

By accessing this website, requesting services, or entering into a service agreement with DJ AmberLove (“Company,” “we,” “our,” or “us”), you agree to be bound by these Terms of Service. If you do not agree, you may not use our website or services.

These Terms apply in addition to any signed service agreement. In the event of a conflict, the signed agreement governs.

2. Services & Booking

Services include DJ performance, MC services, equipment rental, lighting, and related entertainment services as specified in a written agreement.

An event date is not reserved until:

  • A written agreement is signed; and

  • The required non-refundable retainer is received.

We reserve the right to decline service at our discretion.

3. Payment Terms

  • Retainers are non-refundable unless otherwise stated in writing.

  • Final balances must be paid by the deadline outlined in the service agreement.

  • Late payments may result in cancellation or refusal to perform services.

  • Overtime and add-on services are billed at agreed rates.

  • All pricing, proposals, and service details are confidential and may not be shared without written consent.

Client agrees to pay all reasonable costs of collection, including attorney’s fees, if payment obligations are not met.

4. Cancellations & Rescheduling

Cancellation and rescheduling terms are governed by the signed service agreement.
No refunds will be issued outside the terms stated in that agreement.

5. Client Responsibilities

Client agrees to:

  • Provide safe working conditions

  • Ensure adequate power supply and performance space

  • Comply with venue rules and local regulations

  • Obtain any required permits or licenses

The Company reserves the right to cease performance without refund if conditions are unsafe, illegal, or materially breach agreed terms.

6. Limitation of Liability

To the fullest extent permitted by law:

  • The Company shall not be liable for indirect, incidental, consequential, special, or punitive damages.

  • Total liability shall not exceed the total amount paid under the applicable service agreement.

  • The Company is not responsible for venue restrictions, guest conduct, weather conditions, or third-party vendor failures.

7. Indemnification

Client agrees to indemnify, defend, and hold harmless [Your DJ Business Name], its owners, contractors, and affiliates from and against any claims, damages, losses, liabilities, or expenses (including attorney’s fees) arising out of:

  • Client’s breach of these Terms

  • Guest misconduct

  • Venue-related incidents

  • Any unlawful activity occurring at the event

  • ​

8. Force Majeure

The Company shall not be liable for failure or delay in performance due to events beyond reasonable control, including but not limited to:

  • Acts of God

  • Natural disasters

  • Government orders

  • Illness or emergency

  • Equipment theft or catastrophic failure

  • Transportation disruption

In such cases, remedies will follow the signed service agreement.

9. Intellectual Property

All branding, logos, website content, mixes, marketing materials, and original content remain the exclusive property of [Your DJ Business Name].

No reproduction, distribution, or commercial use is permitted without written consent.

10. Website Use Restrictions

You agree not to:

  • Use this website for unlawful purposes

  • Attempt unauthorized access

  • Copy or distribute proprietary content

We reserve the right to restrict access for violations.

11. Dispute Resolution

Any dispute arising out of services or these Terms shall first be attempted to be resolved through good faith negotiation.

If unresolved, disputes shall be resolved through binding arbitration in the State of Washington, unless otherwise required by law.

Each party shall bear its own legal fees unless otherwise determined by the arbitrator.

12. Governing Law

These Terms are governed by the laws of the State of Washington, without regard to conflict of law principles.

13. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.

14. Modifications

We reserve the right to modify these Terms at any time. Updated versions will be posted with a revised effective date.
